Fence Repair Questions We Hear Across Dartford

Who is responsible for repairing a fence?
The owner of the fence is responsible for repairing it, and ownership is set out in your property deeds. Look at your title plan: a "T" mark on your side of the boundary means the fence is yours; two T's joined into an "H" mean it's a shared party fence with responsibility split between both households. The old beliefs about "the left-hand fence" or "the side with the posts" are just customs — they carry no legal weight. If the deeds are unclear, the fence is generally treated as jointly owned.
How do I find out if a fence is mine?

Can I force my neighbour to repair a fence?
In most cases, no — there is no automatic legal duty in the UK for a homeowner to maintain a boundary fence, unless their deeds contain a specific maintenance covenant. Your best route is a conversation about sharing the work, or building your own fence just inside your side of the boundary line, which needs no permission from them. If a collapsing fence is genuinely dangerous, you can report it to the council's Building Control team via GOV.UK. Citizens Advice offers free guidance on boundary disputes if it escalates.
Can I go into my neighbour's garden to repair my fence?
Not without permission — entering uninvited is trespassing. Always agree access first; most neighbours say yes when asked politely with a date and time. If they refuse and the repair genuinely can't be done from your side, the Access to Neighbouring Land Act 1992 lets you apply for a court order granting access for essential repairs, though that's a slow last resort. Is it worth repairing a fence instead of replacing it?

If a neighbour or their contractor caused the damage (a falling tree they'd been warned about, a vehicle, careless work), they are liable instead. If you rent, your landlord is generally responsible for fences they installed, but tenants are liable for damage they or their guests caused.
Can an old, weathered grey fence be restored?
Yes — if the posts are solid, a weathered fence can usually be brought back rather than replaced. Restoration means securing or replacing damaged boards, cleaning off the grey oxidised layer plus algae and mildew, and re-finishing with a high-quality stain that blocks UV and moisture.
